   Small Win for CA DVD Hackers

   A tongue-in-cheek jab at their adversaries almost went sour for a
   group of DVD hackers attending a court hearing in San Jose earlier
   this week.

   But Santa Clara Superior Court Judge William J. Elfving denied a
   request by the DVD Copy Control Association to submit code-bearing
   T-shirts into evidence on Friday.

   The DVD CCA represents the motion picture and DVD industries in its
   suit against 72 hackers and Internet authors accused of trade-secret
   theft.

   A group of the defendants' sympathizers had handed the T-shirts, which
   feature a DVD CCA logo and a red line through it on the front, and the
   source code to the CSS decryption software on the back, to the
   plaintiffs' attorneys on the way out of the court house at a
   preliminary injunction hearing earlier this week.

   "Here, take these," some of the hackers said. "They're from a bunch of
   criminals."

   Friday's rush request hearing is the third in the case filed in
   December by the Morgan Hill, California-based DVD CCA against 72
   hackers and Internet authors accused of stealing trade secrets. So
   far, Elfving has denied plaintiff's request for a temporary
   restraining order and has yet to decide on the DVD industry's request
   for a preliminary injunction.

   The defense, which says the hackers are simply open source advocates
   trying to learn how to play DVDs without the Windows OS, hopes
   Friday's development spells good things for them.

   "I'm optimistic," said Robin Gross, attorney from the Electronic
   Frontier Foundation, which is representing the defendants in this case
   and in two related federal cases in New York and Connecticut. "But
   it's still anyone's game."

   Plaintiff's attorneys from Weil, Gotshal & Manges were not immediately
   available for comment.
